BART rider belly-down when shot, lawyer says

(01-03) 15:34 PST -- The 22-year-old man killed by a BART police officer early New Year's Day was lying face-down on the train platform, his hands behind him waiting to be cuffed, when he was shot in the back, a lawyer newly hired by the man's family said Saturday.

Attorney John Burris said in an interview that a number of witnesses to the shooting at the Fruitvale Station in Oakland have told him Oscar Grant was posing no threat to the officer or anyone else when he was fatally wounded. The shooting occurred around 2:15 a.m. after police responded to a report of a fight on a train bound for Dublin/Pleasanton.

"If it happened the way the (witnesses) said it happened, he's on his stomach, his hands pulled up behind his back, he's compliant, the officer is standing over him and all of a sudden he shoots," Burris said. "The bullet went through his lower back, hit the ground and ricocheted through the upper part of his body."

The witnesses told him police handcuffed Grant after he was shot, but removed the cuffs just before news reporters arrived, Burris said. No weapons were found on Grant or anyone else involved in the altercation on the train.

Grant, of Hayward, died at Highland Hospital in Oakland several hours later. BART officials say the officer who shot him, a BART police officer for almost two years, has been placed on administrative leave during an investigation. He has not been publicly identified.

...Burris said BART police stopped the fight and took Grant and several others into custody. Officers were armed with stun guns as well as pistols, Burris said, and a witness said Grant cried out, as he lay on the platform, "Please don't Tase me, I have a 4-year-old daughter."

There definitely is a sense in our urban areas where there is no respect for the life of black men. I will say, California is about the only place in the country that cop would'nt be thrown in jail immediately. The Union in CA is way too powerful.

I knew Oscar at one point for about almost a year through someone else, I was so shocked when I found out. I am spreading the word through relatives and friends online and I hope it gains National awareness, this is not acceptable.

We are the most powerful force in America so when are we going to rise up and shake the foundation of this country? I must say people that the main stream black leadership in this country are weak. Now if Martin Luther would be alive today we would not have these problems. But the worst part about things the young generation of activist believes everything is going to be alright so party first and then work.

So until we are ready to die for what we believe in then nothing will change. Mr. Brooks

Hunting season is in effect for Blacks. Five police officers in Oakland, CA handcuffed Oscar Grant and fatally shot him in the back on New Year's Day. One cop tasered Grant who pleaded for his life citing his four-year old daughter. The assailant has resigned from the police department to exercise his Fifth Amendment rights.
Blacks lack the organization and the resources to defend themselves in addition to not enjoying a lack of legal and political representation. Slave codes are given birth in legislative branches of governments and enforced in judicial branches. We are in dire need of a Powell, Wright and Maddox

I just can't get over all the voices I heard shouting over the video from the police attack. As all these people of color watched the lynching the cops didn't even look nervous. Even after the fatal shot and people shouted not a signal warrior was in the buch to step up. So not only do we finance our own oppression we also now are witnesses to our lynching.

KING DAY events occur calling attention to Dr. King's statements against violence against the Black Man, social and economic justice and not just the "I Have A Dream" passage. Read the last speech he made at Riverside Church. Read the words that got him killed for saying.

The Gathering’s Mission

The mission of The Gathering is to build an Intergenerational, movement, rooted in history, cultures and non-violent direct action to heal communities, build collective strength and generate an environment of hope and opportunity.

Civil rights and social justice organizations have come to understand that collective action on a national basis is required to stop child incarceration and challenge the immoral process which perpetuates an unjust justice system. These groups are working under extremely difficult circumstances and many of them with little or no resources. The Gathering is a national movement that creates a coordinated space to 1) fortify relationships between regional groups, 2) support local endeavors and 3) enhance the ongoing organizing of non-violent direct action training. Central to its mission is strengthening our moral environment.
